 2007-09-14 Woman collides with pallet jack sues Wal-Mart (By Michelle Massey)

Two days before Christmas in 2005, Dawn Howell was shopping in a Longview Wal-Mart when she fell after colliding with a pallet jack. Howell filed suit against Wal-Mart on Sept. 10 in the Marshall division of the Eastern District of Texas. According to Howell, she was standing in an aisle looking at merchandise when a Wal-Mart employee maneuvered a pallet jack behind her. When she moved "from a standing position," the machine collided with her. Howell states that Wal-Mart's negligence caused her to fall and "sustain severe personal injuries." Plaintiff is seeking damages in excess of $75,000 for past and future medical expenses, physical impairment, physical pain and mental anguish and loss of wage earning capacity. Representing the plaintiff is Longview attorney Charles P. Connolly of the law firm Patterson, Connolly and Hughes. Currently, defendant has not responded to the allegations. Judge David Folsom has referred the case to Magistrate Judge Charles Everingham.
